These Terms of Service (“Terms“) govern your access to and use of the website, applications, and software-as-a-service platform offered by ByteAssistAI (operated by DEV MEDPRO) (“ByteAssistAI,” “we,” “our,” or “us”). By accessing or using our Service, you (“User” or “you”) agree to these Terms.

If you do not agree to these Terms, you must not use the Service.

1. DEFINITIONS

  • “Service” refers to the platform, website, software, APIs, and features provided by ByteAssistAI.
  • “Subscription” means your ongoing right to access the Service under a recurring fee model.
  • “Stripe” is our third-party payment processor used to securely process transactions.
  • “User Content” refers to any content or data submitted or generated by users during their use of the Service.

2. ELIGIBILITY

You must be at least 18 years old and capable of entering into a binding legal agreement. By using the Service, you represent and warrant that:

  • You meet the eligibility requirements;
  • All information you provide is accurate and complete.
  • Your use complies with applicable laws and regulations.

3. SERVICES PROVIDED

ByteAssistAI offers AI-powered, cloud-based tools that enable individuals and businesses to automate workflows, generate content, and enhance operations. We may modify, suspend, or discontinue features at any time, including beta features, which may be unstable.

4. ACCOUNT REGISTRATION

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and current information;
  • Maintain the confidentiality of your credentials.

5. PAYMENTS AND BILLING

5.1 Payment Processor

All payments are processed by Stripe, Inc., and are subject to Stripe’s Services Agreement and Stripe’s Privacy Policy. You agree to comply with Stripe’s terms as a condition of using our Service.

We do not store your full payment details. Stripe is PCI DSS-compliant.

5.2 Subscription Billing

  • Subscriptions are billed on a recurring basis (monthly or annually).
  • You authorize Stripe to charge your selected payment method automatically.
  • You may view and manage your billing preferences in your account dashboard.

5.3 Free Trials

We may offer limited-time free trials. If not canceled before the trial ends, your account will be charged the applicable fee on the renewal date.

6. REFUNDS, CANCELLATIONS & CHARGEBACKS

  • You may cancel your subscription anytime, effective at the end of the billing cycle.
  • First-time users are eligible for a 7-day money-back guarantee after their first payment.
  • Refunds outside this window are at our sole discretion.
  • Chargebacks will be contested with supporting evidence. If a chargeback is determined to be fraudulent or in bad faith, your account may be suspended.

7. ACCEPTABLE USE

You agree not to:

  • Violate any law or regulation;
  • Upload malware, spam, or content that infringes intellectual property;
  • Use the Service to generate harmful, deceptive, illegal, or sexually explicit content;
  • Interfere with the Service’s operation or reverse engineer its functionality;
  • Resell or sublicense the Service without written permission.

Violations may result in account suspension, termination, and potential legal action.

8. INTELLECTUAL PROPERTY

  • All software, branding, designs, and content (except User Content) are the exclusive property of ByteAssistAI and its licensors.
  • You retain ownership of your User Content, but grant us a limited license to use it solely to operate and improve the Service.

9. PRIVACY & DATA HANDLING

Our processing of your personal data is governed by our Privacy Policy (linked). By using the Service, you consent to the collection, use, and sharing of your information as described therein.

Stripe independently processes your payment data. ByteAssistAI does not store full payment card numbers.

10. DISCLAIMERS

  • The Service is provided “as is” and “as available.”
  • We make no warranties—express or implied—regarding reliability, availability, or fitness for a particular purpose.
  • You are solely responsible for how you use the Service and its outputs.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • ByteAssistAI shall not be liable for indirect, incidental, or consequential damages, including data loss or business interruption.
  • Total liability for any claim is limited to the amount you paid us in the 3 months preceding the event.

12. INDEMNIFICATION

You agree to indemnify and hold harmless ByteAssistAI, its affiliates, and its personnel from any claims, liabilities, or expenses (including legal fees) arising from:

  • Your use or misuse of the Service;
  • Your violation of these Terms;
  • Your infringement of third-party rights.

13. TERMINATION

We may suspend or terminate your access if:

  • You breach these Terms;
  • Required by law or regulatory order;
  • Your conduct threatens the integrity or security of the Service.

You may close your account at any time via your dashboard or by contacting us.

14. HISTORICAL TERMS & CHANGES

When we update these Terms, we will:

  • Post the new version on this page;
  • Maintain an accessible archive of previous versions [here: Insert link to archive or changelog].

Material changes will be communicated via email or in-Service notification.

15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict of laws. All disputes must be resolved in the state or federal courts of Salt Lake County, Utah, and you consent to the jurisdiction of such courts.
